Acceptance of Terms

By creating an account, using any Subix product, or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms of Service.

These terms constitute a legally binding agreement between you (or your organisation) and Subix Inc. If you are accepting on behalf of a company, you confirm you have authority to bind that company to these terms.

If you do not agree to these terms, you must not use Subix products or services.

Services Description

Subix provides a combination of software products and managed digital services:

• LeadOS CRM — A SaaS CRM platform for managing sales leads, pipelines, and follow-ups
• HRMS — A Human Resource Management System for employee lifecycle, attendance, leaves, and payroll
• Web Development — Design, development, and deployment of websites and web applications
• Performance Marketing — Paid advertising management on Meta, Google, and other platforms on your behalf
• Content & PR Services — Content creation, short-form video, PR placements, and brand positioning
• AI & Automation — Custom workflow automation and AI agent deployment

Service scope, deliverables, and timelines are defined in your specific project agreement or subscription plan.

Account Responsibilities

You are responsible for maintaining the security of your account credentials. Do not share your password or session tokens with unauthorised users.

• You must provide accurate and complete information during registration
• You are responsible for all activity occurring under your account
• You must notify us immediately at contact@subix.in if you suspect unauthorised account access
• One account per organisation unless explicitly agreed otherwise in your plan
• Subix support staff will never ask for your password via email or phone

Payment & Billing

Paid Subix subscriptions and project engagements are governed by the following billing terms:

• Software subscriptions are billed monthly or annually in advance
• Project-based services (web, marketing, automation) are billed per the project proposal milestones
• All prices are in INR unless otherwise specified; GST is applicable as per Indian tax law
• Payments are non-refundable except where explicitly covered by our Refund Policy
• Failed payments will result in service suspension after a 7-day grace period with reminder notifications
• We reserve the right to change pricing with 30 days' written notice before your next billing cycle

Intellectual Property

Your Content: You retain full ownership of all data, content, and business information you upload to or create within Subix products. We do not claim any rights over your business data.

Subix Platform: All source code, design systems, UI components, and proprietary algorithms powering the Subix platform are owned by Subix Inc. You receive a limited, non-transferable licence to use the platform as a subscriber.

Deliverables: Upon full payment, all custom deliverables (websites, apps, content) created exclusively for you become your intellectual property. We retain the right to display them in our portfolio unless you request otherwise in writing.

Prohibited Use

You agree not to use Subix products or services for any of the following:

• Spamming, phishing, or sending unsolicited bulk communications via LeadOS
• Storing or processing data in violation of applicable privacy laws (GDPR, IT Act)
• Reverse-engineering, decompiling, or attempting to extract source code from our platform
• Using our services to build a competing product or service
• Uploading malicious code, viruses, or exploits to our systems
• Impersonating other users or organisations within the platform
• Any activity that violates Indian law or applicable international regulations

Violations may result in immediate account suspension and legal action where warranted.

Termination

By You: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. Data export is available for 30 days post-cancellation.

By Subix: We may suspend or terminate your account with 14 days' notice for any breach of these Terms. In cases of fraud, abuse, or illegal activity, termination may be immediate without notice.

Upon termination, your access to the platform ceases immediately. We will retain your data for 30 days before permanent deletion. You are responsible for exporting data before termination.

Limitation of Liability

To the maximum extent permitted by law, Subix's total liability for any claim arising from these terms or your use of our services shall not exceed the fees you paid to us in the 3 months preceding the claim.

We are not liable for: indirect, incidental, or consequential damages; loss of revenue or business opportunities; data loss beyond our documented backup policies; or third-party service failures outside our control (payment processors, hosting providers, etc.).

Our services are provided "as is". While we aim for 99.9% uptime on our SaaS products, we do not guarantee uninterrupted service.

Contact & Disputes

These Terms are governed by the laws of India. Any disputes arising shall first be attempted to be resolved through good-faith negotiation. Failing that, disputes shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka.
